While you do not "need" a lawyer present when you appear in Court, an experienced criminal defense attorney may be able to assist in identifying pssible facts/defenses that could result in the reduction of charges or even outright dismissal of the case. You can be charged. In Utah, you have to have "actual physical control" of the car to be convicted of DUI. You have an argument that you weren't in control of the car, though, so you may want to hire an attorney to help you fight the charge.
