If you are going to be "evaluated" by the court, I suspect that you will be drug tested, if this is the case then you should be clean unless you want the court to be more involved with your life then they are right now.

If you refuse a Breathalyzer, your license gets suspended, without exception. You can refuse it - you just lose your license. I do not buy that the lights being out is a conspiracy that justifies a class action and I don't believe you will find a lawyer who thinks that is a case.

Not for a DUI. Reason being that each subsequent conviction of a DUI carries with it a more severe penalty. If your record were purged then it would not be clear as to the number of past DUIs you had
