Not a crime but there could be civil liabilities. (They could try to charge the owner under some kind of accomplice theory but I have not heard of this before.)

It's a gray area. Technically, Texas should uphold the suspension, but you never know if they are going to look. They are government employees after all.

Basically if you don't take it for any reason they can count it as a refusal. It would only be an Erdman issue if he coerced you into taking it. But you never took it right?
