I don't think the concept of statute of limitations applies to your situation. You got an OWI about 9 years ago. If it was a first offense, and in Wisconsin, it is not a criminal offense in any case. Some OWI's do not count in calculating the penalty for a later OWI, if they more than 10 years old. But they don't necessarily disappear from the record. You might want to consult a skilled OWI lawyer to see if there is some way to get the original judgment vacated, but that is not often successful.

There is nothing you can do to effect what charge is filed. They may have cited you for drunk in public because you were drinking when they came to where you were. They may not be able to prove whether you were under the influence at the time of the accident. If they took your license you will need to request a hearing within 10 days of your arrest.

It would be unethical for me to advise you as to how to plead when not serving as your attorney. It is very important to consider hiring an attorney despite the cost to represent you in a DUI case. The ability to potentially avoid the long-term negative effects to your life and your ability to seek employment after a DUI conviction can be worth the cost of the attorney by themselves. If you cannot afford private counsel then you should certainly consider requesting that the court appoint a public defender to your case. Working with an attorney may allow you to negotiate a plea deal in return for reduced and/or suspended charges or sentencing but every case is different.
