Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Usually, the D.A. has one to file charges in a criminal case. Once the charges are filed, the statute of limitations no longer runs. The fact that an arrest warrant was issued 7 months after the initial incident, means that criminal charges were either filed at the time the warrant was issued or sometime before that. You may have a speedy trial defense depending on many factors too numerous to go into here. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

Yes. The issue is whether you intended to drive while intoxicated. Thus, if a person is sitting in the driver seat with the key in the ignition and is drunk, the police can charge that person with Driving While Intoxicated. The person did not actually have to be driving or seen driving. The case could be brought for a jury to decide.

Its not clear where you are procedurally. If you signed an SCI form, you waived the matter going before a grand jury. Yor attorney will meet with the judge and ADA and get an offer. If you didn't sign an SCI (superior court information), the DA's office could be going forward with the presenting to the grand jury. You will be notified to appear in court to deal with the matter. If you were arrested while on probation, that is an automatic violation of probation. Whether you go to jail or not depends on the recommendation of the probation officer, the ADA and judge.
