You need to win a hearing before the Administrative Hearings Section of the Secretary of State. You will have to prove at least 12 months of no alcohol whatsoever, and you should provide written evidence of your regular attendance in a structured support group to maintain sobriety, like AA. You will have to submit a proper Substance Abuse Evaluation from a licensed professional, and 3 - 6 letters from your AA sponsor, friends, family and co-workers verifying you being alcohol free for at least 12 months.

Can he do whatever he wants? yes, can you fight it? Sure, give it a try if you have defenses to the ticket. His headlights off are not a defense, or relevant to the ticket unless it is for ?refusing to stop for police?. You have nothing to lose but time and income.
