Can they impound my car since I have never had a DWI and was not with my girlfriend at the time?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Yes, your car can be seized when the driver is arrested. You should be able to go to the impound yard and get your car released. They cannot keep your car, it is your property, not that of your girlfriend.

Depending upon what state you are in and what "extreme" means, you still should be eligible for probation.

DUI/DWI is a serious charge. the nj supreme court said no 'plea bargains' on DWI. your attorney must attack the basis for the 'stop' of the validity of the 'field test'. what was the basis for your son being stopped ? what were the 'field tests' ? what was the breathalyzer reading ? these are crucial facts i need to know.
