Is a toxicology report a good defense for hit and run and DUI charges?

Not necessarily. You need to go over that report with a fine tooth comb. Start by showing it to your doctors to see what he or she thinks.

What are my chances of still getting charged since it has almost been 2 years since the DUI offense?

There could be a warrant out for you. If you have a paper driver license, you will not be able to get a new one because your driving record may be flagged. You should have been given paperwork telling you when to come back for your arraignment.

I'm on probation for a DUI and I have been pulled over 3 times for driving on a suspended license. When I go to court, will I get any jail time?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)

You may not get any (or much) jail time for the suspended license charge, but you risk having your probation revoked, and then there would very likely be some jail time. Stay on the best of terms with your P.O. Good luck.
