Does your drivers licence get taken away after a DUI?

default-avatar
Answered by attorney Eric J Trabin (Unclaimed Profile)
DUI/DWI lawyer at The Trabin Law Firm, P.L.
Yes. Upon arrest for a DUI a license will be suspended for at least 6 months. The police will provide a person with a 10 day temporary driver license. He may be eligible for a hardship license after a minimum of 30 days, but that won't necessarily help you. Keep in mind if he is convicted of the DUI then his license will be suspended again from the date of conviction. He needs a lawyer.

What can I do on a DWI case that still ongoing for a year?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
Why has it been delayed for that long? Are you represented by an attorney? If not, you should retain an experienced DUI attorney in your area as soon as possible. Is the prosecution delaying the case because of lack of evidence or is the defense delaying it for some strategic reason? A lot more information is needed before a more accurate answer can be given. Usually there are statutory mandates on how long the court has to bring a misdemeanor case to trial. If it has not come to trial in that time period, there would need to be good cause for why it has been delayed for so long.

If a prosecutor decides not to prosecute at the time of trial. Did a trial take place?

Thomas S. Hudson
Answered by attorney Thomas S. Hudson (Unclaimed Profile)
DUI/DWI lawyer at Hudson Law Office
If a trial lawyer is doing his job right, 2/3 of the work is done before the jury is sworn. So if you did jury selection and the case was dismissed after that, then the lawyer deserves to be paid for the trial. In my representation agreements, I make it clear that the trial fee is refundable until a jury is sworn. After that, it is earned.
