Will I have jail time for a possible charge for driving while suspended?

Gregory Casale

Unless it is a subsequent offense or your license was suspended for an OUI, you should not get jail time. If it was either a subsequent offense or your license was suspended for OUI, yes, you certainly can be sent to jail.

Can I get charged with a DUI if I wasn't in my vehicle and the officer didn't even see me driving?

You have so many legal issues as viable defenses. You need to contact a criminal defense lawyer immediately to address this case. The blood test can take around 30 days for just alcohol screening or up to 69 days for drug screening.

If I got a DUI in May 2005, should I report this on job applications even after I completed probation?

If you were actually convicted of the DUI, it will appear on a criminal background report. If you were given a suspended imposition of sentence (SIS) with probation, then if you successfully completed probation without any violations, there should be no conviction on your record. Applications for professional licensing often ask, "Have you ever pleaded guilty or been convicted of a criminal offense?" If so, the answer would be yes, you have pleaded guilty but you were not convicted. (With an SIS, you have to plead guilty to the original crime before the judge will suspend the sentence and put you on probation.)
