If my boyfriend was arrested for a DUI and does not have papers (illegal) does that mean he will be deported?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
Your boyfriend needs to consult with both an experienced DUI attorney and an Immigration attorney. From my experience it is possible he could be deported. However, an arrest alone does not equal guilt and it is important to review the case in depth before making any decisions on guilt or innocence. This could also adversely affect his ability to become a U.S. citizen in the future.

Is it possible to get a reduced charge for a DWI if I was not caught driving?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)
DUI/DWI lawyer at Steven J. Alpers, A Professional Corporation
It is possible to prove such a case. Police are allowed to investigate accidents, even if they did not witness the accident. The statement of the person who called them and then followed you is enough to justify field sobriety tests. The only question may be if you could have been drinking enough at home after you arrived to make you a .19. The body takes about an hour from the last drink to fully absorb the alcohol into your blood stream.

What is going to happen to my DUI charge in Michigan since I live in Tennessee?

Answered by attorney John F Brennan (Unclaimed Profile)
DUI/DWI lawyer at Musilli Brennan Associates, PLLC
Clearly, the fact that you are a resident of Tennessee does not provide you a defense to a DUI committed while you're in Michigan. Generally, the states share databases and if you fail to appear or are assessed various penalties in Michigan and will transcribe it to your Tennessee driving privileges. You should be engaging a Michigan attorney to seek to mitigate whatever damages your actions may visit upon you.
