Can my wife serve maximum jail time for DWI?

default-avatar
Answered by attorney Edward Jerome Blum (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Edward J. Blum
It depends on the facts of her case. It is mandatory that she serve 4 days if convicted. She will also have to serve some time for probation violation if the violation is proven. She will be eligible for a public defender who can advise her. If she's convicted,, she will be given an option to convert almost all her fines/fees to jail or community labor.

What will happen on our house and property with the DUI charge?

Answered by attorney Steven Fairlie
DUI/DWI lawyer at Fairlie & Lippy, P.C.
If your BF puts car in his name and then lets known drunk driver drive it, that is pretty much the definition of negligent entrustment whereby your BF could be sued if anyone was injured. Not a good idea.

Are two DUI charges considered a felony?

No. It is still a class B misdemeanor. Depending on the facts, there may be some difference to what I have written. But generally, you are facing The Utah Driver License Division and the Utah Courts will impose sanctions on a person for being arrested and/or convicted of driving under the influence. The Utah Driver License Division may impose sanctions based on the person's arrest. Additionally, the Utah Driver License Division will impose sanctions upon conviction. If convicted, Utah Courts will order mandatory sanctions. Additionally, there are a number of sanctions the Utah Courts may order.
