Can you be convicted of DUI if you were not driving?

Answered by attorney Brad Alan Howell (Unclaimed Profile)
DUI/DWI lawyer at Meadows & Howell, LLC
Yes, you can be convicted of a DUI even if you were not driving. Alabama only requires that you be in actual physical control of the vehicle, which means that you are present inside the vehicle and capable of operating it in some manner. Due to this law, many people who pull over and try to "sleep it off" behind the wheel will wind up being charged with a DUI.

Can you get charged with a DUI if someone saw you driving then the cops came and arrested you inside your home?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Yes, you could be charged. It is not necessary for a police officer to see you driving for you to be charged with DUI. However, that does not mean you have no defenses. For one, the police need an arrest warrant or your permission to come into your home. You said they "barged inside" which might mean some or all of the evidence could be suppressed. Also, a prosecutor, in court, would need to prove you were drunk when you were driving. It could be argued that you started drinking once you got home. In any event, you should hire a lawyer immediately to help you, and do not talk to the police without your lawyer present.

Will they revoke or suspend my teaching credential if I did not attend the hearing?

Matthew Murillo
Answered by attorney Matthew Murillo (Unclaimed Profile)
DUI/DWI lawyer at Law Offices of Matthew Murillo
It's a possibility. But this is not an appropriate forum for that. You should call your teachers union. Because I don't think the hearing was scheduled for a last minute appointment, I hope you have already contacted your union, rather than simply not showing up. If you don't show up, it may effect you even more than you may imagine.
