They can impound your vehicle, because she was intoxicated. They are going to try and keep the vehicle via forfeiture proceedings.

No, driving while and toxic it is significantly different than driving in need of going to the bathroom. Too much water is not a problem unless it was mixed with whiskey or contained in your beer.
