To begin with, if you were on probation for your DUI, you will have a probation violation which could subject you to a jail sentence. In addition, the driving with a suspended license charge, can also subject you to a jail sentence. I suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. If bodily injury was involved, he probably being charged with a felony and a potential jail sentence of 1 to 3 years minimum. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your husband's case. He/she would then be in a better position to analyze his case and advise you of his options.

If I had blood drawn and the results read .08 alcohol in my system, was I legally intoxicated?

A blood alcohol level of .08 or above raises the presumption that you were intoxicated. However, with a good attorney, you may be able to plead down to a wet reckless charge.
