Answered by attorney Jeffrey Lawrence Pollock (Unclaimed Profile)

Since you were below .08%, unless they can otherwise prove you were Under the Influence and incapable of safe driving, you are not guilty unless you were under age 21.

What happens after a second DUI?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
In Utah, a second DUI within 10 years means you will have your Driver's License suspended for two years and you will likely be sentenced to 10 days in jail. You are also looking at over a thousand dollars in fines. It would be a good idea to have an attorney to help you fight the charge.

We are not sure if my husband has an arrest warrant pending from '06 how can we find out?

DUI/DWI lawyer at The Rogers Law Firm
If you know which court issued the original charges, call that court and ask if there is a warrant for your husband's arrest. Or hire an attorney to run a warrant search.
