What is my next step besides turning myself in to jail without legal counsel?

Gunther Omar Sanabria
Answered by attorney Gunther Omar Sanabria (Unclaimed Profile)
DUI/DWI lawyer at Sanabria Associates
Probably the first thing to do is contact your PO to determine the status of you case. Most likely there was a violation hearing and you didn't know about it. Best case scenario, it didn't take place and an attorney could do something for you. Hope it helps.

Can I go to jail for drinking 3 beers and one half a mixed drink without getting pulled over?

They can try, but the prosecution will have to prove that you were either impaired or your Blood-Alcohol level was above 0.08 at the time that you were driving. The amount of drinks you had alone is most likely insufficient to obtain a conviction.

Do I need a lawyer if I wasnt legitimately arrested?

Answered by attorney Charles D. Scott (Unclaimed Profile)
DUI/DWI lawyer at The Law Offices of Charles D. Scott PLLC
You may need a DUI lawyer, even if not arrested (I'm not sure why they didn't arrest you at the time?) because the State Attorney can still file charges once they receive the police incident report. The ten day notice is for an administrative hearing on the license suspension. You should talk with a lawyer about the ten day hearing and do not drive until you have a proper license. Your license is suspended and if you are caught driving it is a criminal offense and a trip to jail.
