What should I do with my DUI?

Matthew Murillo
Answered by attorney Matthew Murillo (Unclaimed Profile)

If your BAC is anywhere from .08%-.10%, fight it. With those results, its possible for an attorney to get it reduced to a wet reckless and your odds of winning the DMV hearing are much better. A DUI is not a do-it-yourself project. DUI laws are very complex and you would be better served hiring someone to represent you.

Since it’s a misdemeanor, am I able to handle it in my home state?

Your questions should be directed to your attorney. These issues can be worked out but they should be worked out before you leave town. Have your attorney go in for a modification of probation.

If I have a DUI pending and I have been to court, can I do my DUI classes in another state since I'm moving?

No. The only exceptions are people who live near a boarder and can come into CA for the classes. If you are out of state and notify DMV that you will be out of state for 3 or more years they will drop the requirement, if you return within the 3 years you will have to take the classes.
