It depends on your bac limit and whether your car was operable. If your keys were in the car and car was running and you blew over .08, you can be convicted of drunk driving. You really need a lawyer because of the complexities of a drunk driving case and what the potential consequences are. I always recommend using someone local, as they know how the different Judge's and prosecutor's and can usually get a better deal for you than someone from out of town.

DUIs are really too complex to try it by yourself. The stakes are very high because not only do you risk probation, possible jail, fines, costs, ignition interlock, vehicle immobilization, but higher insurance premiums, license points, and driver's responsibility fees. In order to have a chance at all you need an experienced DUI attorney to carefully evaluate every inch of your case including the police reports, cruiser cam videos, calibration and maintenance records of the breath machines and certifications of the operator, among other things. There may be ways to challenge the stop or invalidate the chemical test results or the field sobriety tests. A good DUI attorney will more than pay for himself in what he can save you.

Yes it was a lawful stop and yes the officer had probable cause. Your son is 20, which means that he is under the legal age to drink, which means zero tolerance. There was observed drinking. There was observed driving. You do not say what your son's breath test results were. My advice: hire an attorney.
