Should I plead to lesser charges of DUI?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
DUIs are very serious and can affect people in different ways such as their job and educational pursuits. Keep in mind that DUIs, like all driving offenses, cannot be expunged and forever stay on your criminal record and driving record. They can also be very costly in terms of fines, cost, drivers responsibility fees, probation oversight, and points on your license which will cause your insurance rate to go higher. A good DUI attorney is a solid investment that you should consider to see how the damage can be mitigated. Even though it is a misdemeanor, they are very complex with a lot of variables that can affect the outcome of the case. There may be issues with your case that can be used as leverage when negotiating with the prosecutor for a reduction in charges or dismissal.

Is this fair or legal to get arrested if I have been driving with prescription drugs in my system for 23 years?

Answered by attorney Michael B Dungan (Unclaimed Profile)
DUI/DWI lawyer at Dungan, Lady & Dunga, PLLC
You have a right to take your prescription drugs as prescribed by your doctor and drive, but you have to be able to drive your vehicle safely while the medication is in your system. If the medication effects you to the extent you can't drive safely, you have to stay off of the road. If you were taking the medication as prescribed, and the prosecutor cannot prove bad driving or that you were unable to drive safely because of the effects of the medication on you, you have a good defense to the charge. Although seeing that you have already been in jail for 3 months, perhaps that horse has left the barn.

How can I fight a DUI charge that I disagree with?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
DUI/DWI lawyer at Steven J. Alpers, A Professional Corporation
You raise a number of issues. Miranda rights have to be read if you are in custody and being questioned. It will depend on the facts that led to the officer to come up to your window. If you were fully sober, then there should be no problem with the dui charge. The evidence which will be crucial in your case will be what the officer saw of the way you were driving and how you did on the field sobriety tests.
