They will have to have some evidence of your intoxication.. They would have to have something that would show your blood alcohol content (BAC) or that illegal drugs were present in your system or that you were under the influence of prescription medicine while you were driving. Keep in mind that anybody can be charged with anything. It is one thing to be charged, it is another matter entirely to have your guilt proven beyond a reasonable doubt. Consult with an experienced DUI or OWI attorney in your area.

Always plead not guilty at your first court appearance, otherwise you forfeit your ability to negotiate with the prosecutor. You also need to retain an experienced DUI attorney in your area to thoroughly review your case for any deficiencies that could get the charges reduced or dismissed. A good DUI attorney will evaluate the stop, get any cruiser cam and lapel mics of the stop, evaluate any field sobriety tests to make sure they were done properly, request certifications for the officers conducting the field sobriety tests and the chemical test operator, as well as the maintenance logs for the chemical test machine. There are a lot of variables that go into a DUI and a lot is at stake including possible jail, loss of license, driver's responsibility fees, higher insurance premiums and other collateral consequences that could affect your career and schooling. If there is a bench warrant for you, the statute of limitations does not start. If you have a 3rd offense drunk driving conviction, it can never be expunged.
