An open container is a Class C ticket, like speeding. A open container with a DWI means the driver would have to do 3 days in jail for that open container. So really just depends on you. Open container tickets are pretty cheap and easy to defend. Maybe all should talk and work something out.

Your blood alcohol level may have been rising due to the absorption rate at which alcohol enters your bloodstream. If there was enough time in between the breathe test and the blood sample, that may account for the difference. You may have good grounds to fight the charge and get it reduced or thrown out.

Not a crime but there could be civil liabilities. (They could try to charge the owner under some kind of accomplice theory but I have not heard of this before.)
