If you were convicted in Texas, you have no right to expunge or wipe out the record, but you can go back to the court where you were convicted and file a petition for non-disclosure. If that's granted, and it likely will be if you have only the one offense, nobody but law enforcement should be able to retrieve it. You probably need a lawyer's help.

What is the blood alcohol limit for DUI that the CHP can use their discretion and not take you to jail they cite and release you?

There is a lot more to a DUI than the alcohol content. That is only one part of the statute. The other part of the statute states "... or whose driving is affected to an appreciable degree by the consumption of alcohol and or drugs". Such being the case, you could have a blood alcohol level less than .08 and still be arrested. If you have a commercial drivers license or are a minor, then the blood alcohol level is even less. Your best bet: Don't drink and drive.

Sounds like the prosecutor is going to have a difficult time proving that you had actual physical control of the vehicle. However, make sure you request a DMV hearing. If you do not, you will automatically lose your license. Hope this helps.
