It depends on your Judge, some allow, some do not. Discuss with your attorney; some Judges make clearing up old charges a term of your probation.

You should not be charged with DUI - if no substance that could impair you was found in your system. However- you most likely would be charged with simple possession, if the search could be thrown out depends on what the officer will testify to, if you gave him consent to search- then no. If you did nit give consent to search, it would depend on what reasons the officer gives for the search.

Check the Police Agency policy manual. In Florida there is no requirement police take accident victims to a hospital. If you request EMT's be called they will be; if they appear for the other driver they will always offer to check out the other people involved in the crash. Police will approve transport to a hospital if the EMT's recommend.
