How much is it to get a misdemeanor DUI expunged?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions. With regards to price, there is no universal price guidelines. Every attorney usually charges differently. I suggest that you contact a number of attorneys in your area to see what the going rate is.

Can I get my DUI 2nd dropped down?

Something is going to be done, you are going to see the inside of a jail cell again. Remarkably, everyone that has just had surgery on their leg, foot or eye, so they cannot perform the tests properly, is on the cell phone, which accounts for their traffic citation and refuses to blow, so the courts will know how intoxicated they really are. Why those folks are drinking at all, since they have all of these issues is confusing, but whatever.

Will a DWI charge always show on my record? Is there a way to clear my record after a certain amount of time has passed?

Evan H Nass
Answered by attorney Evan H Nass (Unclaimed Profile)
DUI/DWI lawyer at Nass & Roper Law, LLP
Hi, It depends on what it is you were actually charged with and ultimately what you pleaded down to. If you were charged with a DWI, but took a violation and a 90 day license suspension, for instance, then it will not be on your record. New York state criminal record searches do not include violations, so if you received one, it won't show on your record. Misdemeanors will.  Unfortunately, NY State does not allow the expungment of a record, so if you have one, it will show when a search is conducted, despite the fact that it occurred so long ago.  I hope this helps (hard to answer in more detail without knowing complete specifics on your case). Thanks, Evan H. Nass, Esq Nass & Roper Law, LLP14 Penn Plaza Suite 2004New York, NY 10001718-775-3246
