He may not be dealing with a sympathetic DA so it is hard to say. The proof seems slim. He has 2 possible charges driving with .08 or more alcohol in his system and driving under the influence. They may have trouble proving either. But he is still facing probation violations if the priors were within the last 5 years (normally there is a 3 year probation, but the judge has the power to make it 5 years). For the first dui he would have 6 months hanging over his head less any time previously served. For the second one year less credits. Together that is 18 months assuming they are both active probations. If there is a blood test of .08% then it is possible to be another 12 months in jail. He needs a lawyer.

You are facing a first offense in court and a second offense at the DMV, if the prosecutor tries to charge a second offense, any DUI lawyer should b able to get the "prior" conviction dropped. A quality DUI attorney may even be able to fight your new case.

What is the best thing to do? Not to have driven and been arrested. Now, you get to defend the charges as best you can, and negotiate the best plea bargain you can, or roll the dice and go to trial. Since you already have an attorney, and only that attorney knows all the facts and evidence, I suggest you listen to the advice you get. You can ask the court to appoint a Public Defender if you qualify financially, but having already hired private counsel shows you can afford to do that.
