What should I do after my uncle had my car seized?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
In Michigan, you would be able to have a showcause hearing infront of the judge showing that while the car was your's, you did not knowingly give him permission to drive while you knew he was drunk. Consult with a DUI attorney in your area to see if this is a possibility where you live.

Is it legal to get pulled over for taking too wide of a turn and not turning lights on right away?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Yes, most states prohibit driving after dark (dusk) without illuminated headlights. California Vehicle Code may also prohibit wide turns depending upon the facts. Both driving without headlights and wide turning movements are signs of impairment according to NHTSA, hence law enforcement watches out for these types of driving mistakes during times when people are drinking and driving. Your issue regarding Miranda may or may not be important, you should contact a DUI attorney within 10 days of your arrest to discuss the facts of your case as well as important rights that disappear 10 days after your arrest.

Is there any way that I can fight my DUI?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
DUIs are really too complex to try it by yourself. The stakes are very high because not only do you risk probation, possible jail, fines, costs, ignition interlock, vehicle immobilization, but higher insurance premiums, license points, and driver's responsibility fees. In order to have a chance at all you need an experienced DUI attorney to carefully evaluate every inch of your case including the police reports, cruiser cam videos, calibration and maintenance records of the breath machines and certifications of the operator, among other things. There may be ways to challenge the stop or invalidate the chemical test results or the field sobriety tests. A good DUI attorney will more than pay for himself in what he can save you.
