Hire a good post conviction attorney or an attorney who specializes in appeals. That's your only option. The good ones are expensive though.

You would benefit from having a lawyer, but you could wait until you receive a summons with a copy of the complaint. They cannot charge you for having a Prohibited Alcohol Concentration, but they could still charge you with drunk driving, and use any test result above .04 as evidence. There are some defenses, however, which a good lawyer could tell yo.

If you were arrested you should have been read your Miranda rights prior to being questioned. If you were questioned after you were arrested you should be able to challenge the statements. Unfortunately, as is often the case, the interrogation occurs prior to the arrest and statements made prior to arrest are not subject to the protection offered by Miranda. You should consult with a DUI attorney, they can help you figure out how to defend your case.
