How am I the one who gets the Driving Under the Influence?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Based on what the witness said, the police think you were driving. You have a very good argument to make to the jury: you were never driving and therefore are not guilty of DUI. Hire a good lawyer to help you make the argument and you should be acquitted.

Can I get a DUI in a parked car?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Yes, it is possible to be convicted. In Utah, you need to be in "actual, physical control" of the vehicle which does not require driving. That being said, you have some good arguments for an acquittal. You should fight the charge and you can avoid a second DUI on your record. Hire a good attorney to help you.

Your insurance may well be cancelled as you will be required to get SR22 insurance, which is high risk insurance and can be expensive.
