How likely is it that I can avoid anymore jail time for a first offense OWI?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
DUI/DWI lawyer at Anthony Overton Van Johnson Associates, P.C.
You need to have an attorney attempt to negotiate a resolution of your case which will avoid any additional jail time. There are statutory minimums for various DUI offenses. An experienced attorney may be able to negotiate a "release on time served" which will avoid having to return to jail to complete serving the statutory minimums.

If you are in Michigan you will need a lawyer. Your blowing 24 will effect the charges and penalties even though it was the fist time you were caught.

Is having the same address enough for the prosecutor to seize my car for OUI and DWLS even if I my boyfriend is not on the car's title?

The prosecutor is allowed to seize your vehicle in forfeiture, because was used in the commission of a crime. Did you know he was using it? Yes. Did you know that he was involved in criminal activity? Yes. Then as far as the prosecutor is concerned you permit the activity when you allow him to use your vehicle.
