There's no question he should fight that case. The medical records can be used to try and compel the DA to dismiss the charge. If they refuse to dismiss, those same records can be used to embarass them at trial. No way in the world he should take a plea on those facts. Never.

There is a common misconception that Driving Under the Influence is different than Driving While Intoxicated. In fact, in Texas there is no difference. The State may prove loss of normal use of mental or physical faculties by introduction of alcohol or drugs into a person's body. The case that is filed is no different and it does not matter if you ingested drugs or alcohol.

I can answer the criminal law part of your question - A dismissed case can be expunged off your record and once expunged you can legally deny its existence.  You should hire a criminal lawyer to have this dismissed case expunged.  You should also consult with an immigration lawyer.   Good luck.
