You are on the borderline of having an excellent defense unless there was an accident. .07 is already below the legal limit for a conviction of Operating While Intoxicated. You could be convicted of Operating While Impaired but, you could also be found not guilty. I strongly urge you to find a good defense lawyer anything you pay to hire a good lawyer will, in the long run, be a very good investment. You have a chance, which is way better than you might think so get your case evaluated by me or someone who has experience in these matters & don't be in a rush to plead guilty at your 1st opportunity. CAN he? Of course, he did, didn't he? When arrested for DUI, whether alcohol or drugs, then upon release from jail or booking the defendant is given documents that include a notice that you have only ten days to file a request with DMV for a hearing on an appeal of the automatic suspension of your license imposed by DMV upon your arrest. That is separate and runs consecutively with any suspension that may be imposed by the DMV, or the court upon conviction. Contact DMV and do so, timely if you think you have grounds for appeal, then appear at the scheduled DMV appeal hearing and present any supporting evidence and testimony.

The fact your son refused a breath test is normally construed as his consciousness of guilt which may make a dismissal difficult even if another officer thought he was OK.
