CAN you be charged? Sure. Whether he can be convicted is a different question. His version of the facts is not the only one. The police reports and blood tests will likely tell a different one. When questioned, arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or statement be used against you, can you be convicted, and what can you do? A little free advice if it is not already too late: exercise the 5th Amendment right to SHUT UP and do NOT talk to police or anyone about the case except with and through an attorney. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does.

The three elements that the government must prove for OUI are Operation, Public Way and .08% or better or impaired operation. You are challenging the Operation element. Case law has established that sitting in the car with the keys in the ignition may satisfy the element of Operation. The idea is that with the keys in the ignition, that you have the ability to drive or operate the vehicle. The operative word is may. It is not a small dunk and certainly may be challenged by your attorney. I assume you will have an attorney to represent you. You certainly should.

Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.
