If you are sitting in a vehicle drunk with the keys in your pocket, you are in control of the vehicle. So, the prosecutor can file DUI charges.

I doubt there is an easy way to get this off your record without getting the charge dismissed. Lawyers are a lot better at this than muggles. A lawyer would review the original stop, to see if there is a reason for suppressing any evidence from the stop, and could put the prosecution to its burden of showing that your driving was impaired, and that it was impaired because of alcohol.

Depends on the wording. If he got deferred, he was not convicted. Does it as if he had adult probation? If so, did he? When they run his record, it will show the DUI so generally it is better to "up" the situation because he will be asked (and if not disclosed, they may think he intentionally mislead.). It really should not matter unless his job involves driving, and he is not likely to get such a job because of potential liability and insurance reasons.
