I was charged with DUI and open container what will happen to me?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
The no seat belt stop may save you - not a primary violation, so no reason to stop on a first DUI, they often offer DWAI if you took a test 12-24 months probation alcohol classes 24-48 public service fines etc of 800-1500 if your BAC is over .08, you will lose your license for 9 months, with an ability to get it back on an interlock after 1 month if you refused, lose license for a year

What is the purpose for a blood test and why can’t I use it in court?

Rely on your public defender, since s/he is best informed about your case. I'm not sure you heard him or her quite right, but there is probably more to this than meets the eye. Good Luck.

How can I get my DUI charge downgraded to reckless driving and careless driving?

Answered by attorney Francis John Cowhig (Unclaimed Profile)

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. What was your blood-alcohol level? Did you take a breath or blood test? If you were not driving, who was and how did you get charges with a DUI? I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.
