You can refuse the breath test. It is not an automatic suspension of your license, but the Jury may wonder why you refused. In Kentucky, the Court will likely suspend your license at your first court date and will not grant any driving privileges until the case is over.

You MUST contact the DMV within 10 days of your arrest to schedule a hearing. At that hearing, you can challenge the suspension of your license. If you do not schedule a hearing (or if you lose), your license will be suspended for 4 months.
