Hire a local DAAD attorney to try it again using their best practices. You will need to prove the continued sobriety from 2006 to the present. You can try once a year, but having an attorney is the key.

You are grasping in the dark for any defense to your husband's DUI. The officer does not need to turn on his lights IF the driver is pulling into his driveway. The officer did not pull him over, your husband pulled over on his own. If course, the officer can approach him on private property, IF the officer observed his driving on public streets, before he was stopped on private property. The officer did not arrest your husband for spitting into the machine. He was arrested for DUI.

Regretfully it appears your are a prohibited person under federal law. Any person convicted of an offense for which the maximum penalty, whether or not imposed, is imprisonment in excess of one year (a felony or a misdemeanor carrying a maximum penalty in excess of one year). What constitutes a conviction is determined by the laws of the jurisdiction in which the proceedings were held (state or federal). The prohibition does not apply if the conviction has been expunged or set aside or if the person has been pardoned or has had civil rights restored, unless the expungement, pardon or restoration expressly provides that the person may not ship, transport, possess or receive firearms. If this was your only criminal offense after 5 years from completing your probation, etc you may be eligible for expungement.
