What are my penalties for evading arrest detention of motor vehicle first offense?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
DUI/DWI lawyer at Nelson & Lawless
What are my penalties?? If charged as a misdemeanor, up to a year in jail. If a felony, from one to four years, depending upon the specific charges filed. What will the outcome ?? The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. When charged with any crime, the proper questions are, can any evidence obtained be used against you, can you be convicted, and what can you do? Raise all appropriate defenses with whatever witnesses, evidence and sympathies are available for legal arguments, for evidence suppression or other motions, or for trial. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, program, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

Can my attorney keep the original file copy of my DUI case?

default-avatar
Answered by attorney Brad Alan Howell (Unclaimed Profile)
DUI/DWI lawyer at Meadows & Howell, LLC
This depends upon what you mean by "original file copy." Original copies of the Uniform Traffic Ticket Complaint and similar documentation that was produced by the police or by the court are not kept by your attorney; these are kept by the court. Your attorney likely has copies of them, but they are not the originals. You can always obtain copies of these documents from the court if your attorney does not have them. If you are referring to documentation which your attorney has created in anticipation of litigation, then the attorney may not be required to give you these documents that are considered "work product." Your attorney has the responsibility to give you all other documents in your file upon request, unless you still owe the attorney for work performed.

Am I able to view the video of my DUI before consulting a lawyer?

An accused person has a statutory and constitutional right to disclosure of the evidence which is in the possession of the State and intended to be used against a person. The right to discovery can be asserted by a person who is representing them self (in proper person).
