These cases are fact sensitive. How did the alcohol get into the house ?  Did your three children bring the alcohol to the house ?  How did the person get injured ?  Have there been similar problems in the past ?  The issues may be covered by your homeowners policy. Please call to discuss. Ed Dimon 732-797-1600

If I am driving erratically because I have to pee from drinking too much water can I get charged with a DUI?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
You can get charged with anything. Proving it beyond a reasonable doubt is another matter entirely. To successfully convict you of DUI, the prosecution will need some reliable evidence that you were operating a motor vehicle on a public roadway while intoxicated or over the legal BAC limit to be driving. If you have been charged, you need to seek out an experienced DUI attorney as soon as possible.

Can an officer testify that he was present and heard me say to another that I refused a breath test.

Yes. Officer is a 'fact' witness and can testify that he heard you say that you 'refuse' to take the test. What were the circumstances ? What caused the stop ? What happened on the 'field sobriety tests' ? Ed Dimon 732-797-1600
