The answers to your two questions are: Yes, and yes. But there does not seem to be a lot of published authority from appellate decisions. It will be up to the prosecutor who reviews the police reports to determine what to charge, and IF to charge.

It does not matter, because IF you get the job, one of the conditions will be that you report all arrests, which means you will have to report it, OR play the game which you are trying to play anyway.
