Can a person be guilty of drunk driving if he only had one drink?

If you are under 21, yes. All that must be proven is a detectable amount of alcohol, since any amount is illegal in a minor. A ticket for minor DUI in Texas is not a DWI. It is a fine only offense, with a possible 60 day driver's license suspension.

1) Do not LIE to cover for another person. 2) If you are on probation, you are not supposed to have alcohol or drugs so even if you do not get charged with an offense, your probation can be revoked.

Do I have to do jail time?

J Matthew Catchick
Answered by attorney J Matthew Catchick (Unclaimed Profile)

Whether you will be sentenced to jail depends on your particular Court and assigned Judge, and the facts/circumstances of the incident, and your past criminal history. I would kindly but strongly recommend you consult with a local DUI attorney to present all your best arguments.
