Is it my first OWI or my third?

Answered by attorney Ezra N. Goldman
DUI/DWI lawyer at Law Offices of Ezra N. Goldman P.C.
This is easy. If the Court was a district Court, it was the misdemeanor. If it was the circuit Court, it was a felony.

Do I stand a fighting chance or should I turn myself in because my attorney was not going to represent me until my court date?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
If a lawyer represents you in a matter before a court, he or she must do a complete and competent job unless and until the Judge permits him or her to withdraw. They have no right to refuse to perform a necessary act even if you are behind in payments. He or she should move for permission to withdraw, and serve your legal needs until permission to withdraw is granted. Turn the person in to the Office of Lawyer Regulation.

Did the cop have the right to stop me for a low tire then arrest me for DUI?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
It depends...if it was so low that you posed a danger to yourself and/or other driver's, a Judge will likely find that the stop was reasonable under the circumstances as you must operate your vehicle in a safe manner. These types of cases are extremely fact dependent. In any case, if you blew a .08% on a breath test you have a very good case and need to consult an experienced DUI attorney.
