It depends on the Judge. Sometimes the convert fines into $100/day. Whether they will want to add time for failure to pay may be an issue.

What should I do for a first time OWI charge and how do I avoid losing my license?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Assuming you had your license taken by law enforcement you have 10 days to make a request to the Department of Motor Vehicles (DMV) to request a hearing. The purpose of the hearing is to insure that your rights are protected and that you have an opportunity to be heard before your license is suspended. The pink piece of paper provided by law enforcement delineates the procedure for making the request and what the consequences are if you fail to request a hearing or lose the hearing. You should also contact an attorney in your area to discuss the facts of your case, possible defenses and likely outcomes. Simply because you have been arrested for Driving Under the Influence (DUI) does not mean that you are going to be convicted of DUI. A good lawyer can help.

Does it make a difference if I was not driving when I was arrested for DUI?

The DA doesn't need to prove that the CHP saw you driving. They usually attempt to prove their case by circumstantial evidence.
