It depends on how much meth he had in his system. It is harder to prove driving under the influence of drugs than alcohol because there are no presumptions like the .08% with alcohol. If it was really 2 days earlier there may only be trace amounts and not enough to prove DUI drugs which would be the basis for a murder charge.

If you are looking to fight your case, you can get your case reduced. However, you may be able to do better than that, failure to drive in the proper lanes may not be a legal reason to stop you. Sure they can deny it. However, you can sue the driver civilly and then his insurance will have to defend the case. Also, the criminal court will probably seek restitution on your behalf. You need to check with the DA.
