Can I avoid a DUI conviction if I was charged after crashing into a road closure sign that was unsafe (violate DOT guidelines) to begin with?

It will depend on what your blood-alcohol reading was. The fact that you had 2-3 beers is not enough facts to really analyze your situation. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze you case and advise you of your options.

I was charge with DWI without a sobriety test. What can be done?

You need to retain an attorney. You did NOT blow a 1.1, because that means your blood was more than 110% alcohol. You were not given field sobriety tests, because you were in an accident, which is normal. When you present evidence that you are taking two narcotics, you will make your case worse, because I know the warning label says, DO NOT CONSUME WITH ALCOHOL.

Your 1st DUI causes 8 points on your driving record. Your 2nd DUI causes 12 points to be added to your driving record. Your Missouri license will be suspended for 30 days if you accumulate 8 points within 18 months and it's your first suspension. It will be revoked for 1 year if you accumulate 12 points within 12 months, 18 points within 24 months, or 24 points within 36 months. DUI convictions remain on your Missouri driving record permanently.
