What happens in court if you are arrested for driving without a license and you have a DUI?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
Nothing good. If convicted, you are facing jail time, plus added points on your driving record (which means much higher insurance), more driver's responsibility fees, and more court costs and fines. Retain an experienced criminal defense attorney at once to see if there is anyway the case can be challenged or at least minimize the damage.

Is it too late to ask for Prisoner bracteolate now if my son just began his 70-day sentence for a 3rd DUI?

He should ask his attorney, some jurisdictions do not permit sentences to be completed on electronic home detention. An attorney in the jurisdiction where his sentence was imposed should know the requirements for alternative sentencing, most counties have alternatives to county jail depending on the crime and the duration of the sentence.

You need to plead NOT GUILTY and demand a jury trial. You need to fight the case all the way, and then IF you are found guilty and jailed and license is suspended, you will know that your interpretation of events does not match others interpretation of events. You write "flawlessly" the police write DUI. Let's see what the jury says.
