You are grasping in the dark for any defense to your husband's DUI. The officer does not need to turn on his lights IF the driver is pulling into his driveway. The officer did not pull him over, your husband pulled over on his own. If course, the officer can approach him on private property, IF the officer observed his driving on public streets, before he was stopped on private property. The officer did not arrest your husband for spitting into the machine. He was arrested for DUI.

If you are revoked in Michigan and not eligible for a restoration hearing until 2019, you are not driving legally in any state until 2019. Whatever state you move to will not (should not) license you until you first remove the revocation in Michigan, so whether you move from Michigan or not, you are going to have to clear up Michigan in 2019 before any state will license you to drive.
