This is a difficult question to answer. Depending on the language in the insurance policy, under normal circumstances the policy follows the car. This means that the car and anyone driving it are covered by the insurance policy, unless there is a provision which specifically excludes all drivers not listed on the policy. If you are listed as a secondary driver on the policy, you should be covered by the policy for the accident. However, be aware that the DUI may complicate things and the insurance company may try to avoid liability based on the DUI. If they do, I suggest that you contact an experienced bad faith insurance attorney for a consultation.
