Why do I have to pay an attorney to get my driver’s license back when my case was dismissed?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
First you are talking about two separate things, which is probably why you need an attorney. First, getting your license has nothing to do with expungement. Your license is controlled by DMV. YOur license may remain suspended depending on what you did or did not do when you were arrested for the DUI. Second, the expungement is to get the criminal arrest off of your record. Because you don't know the difference, you probably need an attorney.

They are to read you your rights before they interrogate you following arrest. You are going to need an attorney, they will attempt to charge you with the DUI and violation of the implied consent laws due to the deficient samples.

In my area the Probation Officers will not request or assist in the modification of the terms of probation. You need to contact your attorney to request the court modify the terms or conditions.
