This has less to do with the length of the marriage and more to do with when the pension was earned. Generally speaking, any assets accumulated during marriage are subject to division in a divorce. If someone accumulated pension benefits during the marriage, then the other party may be entitled to receive a portion of those benefits after a divorce. I recommend you consult with an attorney to discuss this matter in greater detail.

begin paying through MISDU.. immediately contact them for instructions. Assert that you have always paid directly.. then File a motion in the court to confirm that in the future you will make all payments through MISDU and to show that you already paid all past. As a part of that motion ask for your child support amount to be re-evaluated due to your change in income. You could substantially cut your financial obligations.

You have no obligation to support children that are not your biological children. Further there is no cause of action in Florida for abandonment, so you are free to move out any time you want. I don't know how long you have been married, but alimony may or may not be an issue if a divorce is filed. If the house is yours and you don't want to move out, that is more difficult. You should file for divorce as soon as possible to start the ball rolling, and file a motion for exclusive use of the home.
